Intelektualno vlasništvo nad softverom, podacima i znanstvenim radovima

Pojam intelektualnog vlasništva

U suvremenom društvu na Zapadu i drugdje omogućeno je vlasništvo nad neopipljivim intelektualnim tvorevinama. Intelektualno vlasništvo poznaje dvije vrste prava:

  • industrijsko vlasništvo (zaštitni znak, patent),
  • autorsko pravo.

Za početak patentnog prava uzima se britanski Statue of Monopolies iz 1624. godine, a za početak autorskog prava također britanski Statue of Anne iz 1710. godine, poznat i pod nazivom Copyright Act 1710.

Prvi kontakt s pojmom intelektualnog vlasništva najčešće se događa kroz audiovizualni sadržaj, iako se tu ponekad nailazi na paradokse.

Koncept intelektualnog vlasništva ima svoje kritičare i reformatore (Electronic Frontier Foundation u SAD-u, EDRi u Europskoj Uniji).

Intelektualno vlasništvo nad softverom

Autorsko pravo

Svaki napisan softver automatski je vlasništvo autora i autor ga može licencirati drugima pod uvjetima kojima želi. Alternativno, autor se može odreći vlasništva i staviti softver u javnu domenu.

Vlasnički softver

Vlasnički softveri razvijeni za komercijalne svrhe često imaju nižu cijenu za akademsku upotrebu. Primjerice, kod Gaussiana, cijena akademske licence je otprilike šest puta niža nego cijena komercijalne licence.

S druge strane, kod vlasničkog softvera razvijenog u akademskom okruženju često se sreće shema licenciranja koja definira različite uvjete korištenja u neprofitne (npr. akademska istraživanja) i profitne svrhe (npr. primjena u istraživanja u korporacijama).

Primjerice, VMD ima sljedeću licencu:

Upon execution of this Agreement by the party identified below ("Licensee"), The Board of Trustees of the University of Illinois ("Illinois"), on behalf of The Theoretical and Computational Biophysics Group ("TCBG") in the Beckman Institute, will provide the Visual Molecular Dynamics ("VMD") software in Executable Code and/or Source Code form ("Software") to Licensee, subject to the following terms and conditions. For purposes of this Agreement, Executable Code is the compiled code, which is ready to run on Licensee's computer. Source code consists of a set of files which contain the actual program commands that are compiled to form the Executable Code.

Problemi autorskih prava

Patent

Patent je oblik intelektualnog vlasništa koji vlasniku daje zakonsko pravo da ostalima zabrani stvaranje, korištenje, prodaju i uvoz izuma u zamjenu za javnu objavu izuma. Bazu patenata diljem svijeta moguće je pretraživati pomoću Google Patents.

Zaštitni znak

Zaštitni znak je prepoznatljivi znak, dizajn ili izraz koji razlikuje nečiji proizvod ili uslugu od svih ostalih.

U zajednici slobodnog softvera otvorenog koda postoji nepisano pravilo da se postojeća imena softvera ne dupliciraju, bila registrirana kao zaštitni znak ili ne.

  • Mozillin web preglednik, inicijalno nazvan Firebird, postao Firefox kako bi se razlikovao od sustava za upravljanje bazom podataka Firebird.
  • Isto vrijedi i kod odvajanja (tzv. forkanja) projekta, paket uredskih alata OpenOffice.org je postao LibreOffice, program prevoditelj GCC je neko vrijeme bio poznat kao EGCS, a alat za molekularni docking rDock forkan je kao RxDock.

Autorsko pravo nad znanstvenim radovima

Isto kao kod softvera i podataka, autorsko pravo nad znanstvenim radovima postoji automatski, ali se često kod objave prebacuje na izdavača (npr. Elsevier, Springer, American Chemical Society (ACS), Cell Press, Nature).

Kod radova objavljenim u otvorenom pristupu (engl. open access, kraće OA) prebacivanja autorskih prava na izdavača nema (npr. MDPI, PLOS, detaljnije za časopis PLOS ONE, PeerJ). Najčešće se koristi licenca Creative Commons Attribution.

Aaron Swartz je 2011. godine iskoristio svoj pristup radovima na MIT-u da sistematsi preuzme velik broj radova s ciljem da ih učini dostupnim javnosti zbog čega je bio uhićen od strane MIT-eve policije i optužen od strane Federalne vlade SAD-a. 2013. godine je počinio samoubojstvo, ali je ostao jedna od značajnih ličnosti u borbi za otvoreni pristup znanstvenim radovima.

Otvoreni pristup dolazi u različitim varijantama koje imaju nazive po bojama: zlatni (pravi otvoreni pristup), zeleni (pravo na vlastito arhiviranje), hibridni (dio radova u otvorenom pristupu, dio ne), brončani (radovi prelaze u otvoreni pristup nakon određenog vremena), dijamantni/platinasti (autor plaća da bude u otvorenom pristupu), crni (piratstvo, npr. Sci-Hub koji je razvila Alexandra Elbakayan i koji je vrlo popularan unatoč svom statusu pred zakonom, Elsevierova tužba, ACS-ova tužba).

Uz izdavače u otvorenom pristupu kao PLOS, veliku podršku istom daje i Electronic Frontier Foundation.

Specifičnosti višeautorskih radova

Većina znanstvenih radova ima veći broj autora i sve je češća praksa da se posebno navodi doprinos pojedinih autora. Jedna od taksonomija doprinosa je Contributor Roles Taxonomy, kraće CRediT, koju koriste brojni izdavači. CRediT je taksonomija visoke razine koja se koristi za predstavljanje uloga koje obično imaju suradnici u znanstvenom znanstvenom radu. Uloge opisuju specifičan doprinos svakog suradnika znanstvenom radu, ima ih 14 i one su:

  1. Conceptualization: Ideas; formulation or evolution of overarching research goals and aims.
  2. Data curation: Management activities to annotate (produce metadata), scrub data and maintain research data (including software code, where it is necessary for interpreting the data itself) for initial use and later re-use.
  3. Formal analysis: Application of statistical, mathematical, computational, or other formal techniques to analyze or synthesize study data.
  4. Funding acquisition: Acquisition of the financial support for the project leading to this publication.
  5. Investigation: Conducting a research and investigation process, specifically performing the experiments, or data/evidence collection.
  6. Methodology: Development or design of methodology; creation of models.
  7. Project administration: Management and coordination responsibility for the research activity planning and execution.
  8. Resources: Provision of study materials, reagents, materials, patients, laboratory samples, animals, instrumentation, computing resources, or other analysis tools.
  9. Software: Programming, software development; designing computer programs; implementation of the computer code and supporting algorithms; testing of existing code components.
  10. Supervision: Oversight and leadership responsibility for the research activity planning and execution, including mentorship external to the core team.
  11. Validation: Verification, whether as a part of the activity or separate, of the overall replication/reproducibility of results/experiments and other research outputs.
  12. Visualization: Preparation, creation and/or presentation of the published work, specifically visualization/data presentation.
  13. Writing - original draft: Preparation, creation and/or presentation of the published work, specifically writing the initial draft (including substantive translation).
  14. Writing - review & editing: Preparation, creation and/or presentation of the published work by those from the original research group, specifically critical review, commentary or revision – including pre- or post-publication stages.
